Spike Last Time Buy Window — Terms of Sale

IMPORTANT: These Terms of Sale apply exclusively to hardware purchases made during the Spike Last Buy Window (8/14/2026 to 9/13/2026). By completing a purchase during this period you acknowledge that you have read, understood, and agreed to these terms in full. These terms supersede and replace all previous Spike Terms of Sale, Terms of Service, and Refund Policies for purchases made during this window.

1. Spike End of Life Notice

ikeGPS has announced the End of Life (EOL) of the Spike product family, including Spike hardware (all variants), the Spike mobile app, and all Spike Cloud services. By purchasing Spike hardware during this Last Buy Window you acknowledge that:

-The Spike product is being discontinued
-Spike Cloud and Spike Pro Cloud services will be permanently discontinued on Wednesday, February 10, 2027
-New Spike Cloud account sign-ups are not available
-New Spike Pro Cloud subscriptions are not available
-Hardware purchased during this window includes access to the Spike mobile app only unless you have an existing Spike Cloud or Spike Pro Cloud account
-The Spike mobile app will continue to function after Spike Cloud is discontinued until it is removed in app marketplaces by Apple & Google

2. All Sales Are Final

All hardware purchases made during the Last Buy Window are final. ikeGPS does not offer returns, exchanges, or refunds on hardware purchased during this period for any reason, including but not limited to:

-Change of mind
-Incompatibility with your device
-Dissatisfaction with the product
-Discontinuation of Spike Cloud services
-The standard 30-day no-questions-asked return policy that previously applied to Spike hardware purchases does not apply to purchases made during the Last Buy Window.

EU customers are excluded from the Last Time Buy Window. Due to statutory warranty obligations under EU law that cannot be waived, Spike hardware purchases during the Last Time Buy Window are not available to customers located in EU member states. Hardware orders to EU shipping addresses cannot be fulfilled for this reason.

3. No Warranty

Hardware purchased during the Last Time Buy Window is sold “as-is” without warranty of any kind, express or implied, to the fullest extent permitted by applicable law. ikeGPS expressly disclaims all warranties, including but not limited to:

-Any implied warranty of merchantability or fitness for a particular purpose
-Any warranty relating to the availability, functionality, or continuity of Spike Cloud services
-Any warranty relating to compatibility with future operating system versions or devices

4. Spike Cloud Services

4.1 No New Accounts

Purchases made during the Last Time Buy Window do not include access to Spike Cloud or Spike Pro Cloud. New account registrations for both services are disabled effective 8/14/2026. Hardware purchased during this window will only function with the Spike mobile app.

4.2 Existing Accounts

Customers who already hold an active Spike Cloud or Spike Pro Cloud account prior to 8/14/2026 may continue to access their existing account until Wednesday, February 10, 2027, subject to the Spike Cloud Terms of Service.

4.3 Service Discontinuation

All Spike Cloud and Spike Pro Cloud services will be permanently discontinued on Wednesday, February 10, 2027. ikeGPS has no obligation to maintain, support, or continue Spike Cloud services beyond this date. The discontinuation of Spike Cloud services does not entitle hardware purchasers to any refund, credit, or compensation.

4.4 Data Deletion

All data stored in Spike Cloud will be permanently deleted following the service discontinuation date. ikeGPS recommends all users export and save their data prior to Wednesday, February 10, 2027.

5. Spike Mobile App

The Spike mobile app will continue to be available on the Apple App Store and Google Play following the Spike Cloud discontinuation date. Basic measurement functionality will remain available via the app without a Spike Cloud account. 

ikeGPS will no longer provide support to the Spike Mobile App and provides no warranty or guarantee regarding:

-The continued availability of the Spike mobile app on app stores
-Compatibility of the app with future versions of iOS or Android
-The duration for which the app will remain available for download

Apple and Google may remove inactive/unsupported apps from their respective stores at their discretion. Removal from app stores will prevent new downloads but will not affect the app’s functionality on devices where it is already installed.

6. Pricing and Payment

All prices are listed in USD. Applicable taxes will be applied at checkout based on the shipping destination. Payment is processed via Shopify’s secure checkout. ikeGPS accepts all major credit cards and payment methods available through Shopify.

7. Shipping

ikeGPS will fulfill hardware orders placed during the Last Time Buy Window via third-party warehouse fulfillment. Shipping costs are calculated at checkout based on destination and shipping method selected. ikeGPS is not responsible for delays caused by carriers, customs, or circumstances outside its control. Risk of loss transfers to the customer upon handover to the carrier.

8. Limitation of Liability

To the fullest extent permitted by applicable law, ikeGPS shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or related to the purchase of Spike hardware during the Last Buy Window, including but not limited to loss of data, loss of revenue, or loss of business opportunity. ikeGPS’s total liability shall not exceed the purchase price paid by the customer for the hardware in question.

9. Governing Law

These Terms of Sale are governed by the laws of the State of Colorado, USA, without regard to conflicts of law principles. Any dispute arising from these Terms of Sale shall be resolved in the state or federal courts located in Denver, Colorado.
